I Travel by Boat is a sailing matchmaker, pairing up people with boats for the most enriching travel experience there is! Our main sailing area is the San Blas islands (Guna Yala) of Panama, but we have boats all over the coast of Panama and Colombia. The San Blas are unique in the world because they have been kept totally wild and virgin by the Guna indigenous tribe, the islands' sole inhabitants. They live in palm, thatched roof huts, fish their meals and cook on firewood. The islands have white sand beachs, tons of coconut trees, and are surrounded by the clearest turquoise water. You can snorkel around every islands as they sit on coral reefs, and you'll see the most spectacular show of colors between the thousands for sea creatures and plants that live just inches from the surface. I TRAVEL BY BOATprovides an online platform that connects boat owners for charter trips thatare made available for booking by guests seeking to book such charter, whichservices are accessible at itravelbyboat.com. The boats listed on itravelbyboat.com arenot owned by I TRAVEL BY BOAT. The yacht charter arrangement is made by us, ITRAVEL BY BOAT, acting as an agent on behalf of the charter yacht owners.In paying your deposit you are deemed to haveread and accepted the following terms and conditions, which form the agreementbetween you and us. The details of your yacht charter will be sent to you andare stated on your confirmation email. If there are any significant changes tothe price or any other arrangements you will be told at the time of booking;once you have booked, we will do our best to let you know of any changes beforeyou travel.When making your booking you guarantee thatyou have the authority to do so and you accept on behalf of your yacht charterparty the terms of these booking conditions. You should check the details ofyour confirmation, as stated in writing on email, carefully to ensure that itaccurately reflects the booking you have requested and immediately inform us ofany discrepancies. This agreement is made on the terms of these bookingconditions which are governed by Panamanian Law and we both agree to submit tothe jurisdiction of the Panamanian Law at all times.We do not accept responsibility for the actsand or omissions of the crew on the yacht you booked. In all scenarios, ITRAVEL BY BOAT is a sales intermediary and cannot be held responsible for anyevent occurring on board or outside the vessel and during the transfers to/fromthe vessel. We do not accept responsibility if the fault is caused by you orany member of your party, a third party or an event which we could not with duecare have foreseen or avoided.If I TRAVEL BY BOAT books a yacht for you withanother charter agent the booking is subject to the standard terms of thecompany with whom we have booked your yacht charter. Below are the conditionsunder which the charters on the website are offered.Charter includes:· Rental of the boatwith crew as described on the boats profile on itravelbyboat.com.· All meals taken aboard(catch of the day, meat, fresh fruits and vegetables). Some boats may exclude 1meal when chartering for a longer period (often a week or longer). Thismeal will be taken on shore on client own expense.· A selection of drinksin reasonable consumption. Not all boats include alcoholic beverages in thecharter fee. This will be stated on their profile. If you have any specificwishes for beverages please let us know in advance.· Fuel, gasoline, watertank supply.· Dinghy with itsoutboard engine.· Twin seats kayakaboard some of the boats (please verify on the boats profile).· Snorkeling gear(always better to bring your own if you have it) and fishing rods.· Spear fishingequipment may be available (please verify on the boats profile).· Sheets and showertowels.· General cleaning ofthe boat after the charter. Charter does not include:· Personal expenses· Tips· Personal travelinsurance and third part liability insurance.· Expenses incurredwhile not on-board the boat: For example: air and land.· Transportation to theboat, local taxes, local visits, community fees, additional excursions,meals in local restaurants, etc. Payment policyDeposit: To confirm your booking a downpayment is required within 7 days of your reservation.More than 6 months before the first day ofcharter a 20% down payment of the total charter fee is required.Between 90 to 179 days before first day ofcharter a 60% down payment of the total charter fee is required.Between 89 to 60 days before first day ofcharter a 70% down payment of the total charter fee is required.Between 59 to 30 days before first day ofcharter a 80% down payment of the total charter fee is required.Between 29 days before first day of charter a100% payment is required.Payment MethodsThe payment methods weaccept are; bank transfer and credit card.When you request topay by bank transfer you will receive account informationfor our bank in Panama. This account accepts USD money transfers. We do notcharge additional fees for this payment method, however, any transactionfees charged by the bank are for the senders account.When paying by credit card we will add a 7% credit cardcharge to the total amount. We accept credit card payments via the PayPalplatform.If you are convertingfrom Euros to US dollars, we handle the exchange rate from www.xe.com. Final paymentFinal payment is due no later than 1 monthprior to charter commencement. Balance reminders are not issued. If youfail to pay on time, the company reserves the right to cancel your charter,without refund of your deposit. The final payment will be held in the accountof I TRAVEL BY BOAT until it is paid to the charter or travel supplier. PricesPrices detailed are subject to change at anytime until full payment has been received. We reserve the right to correct anypricing errors or omissions that may occur. We recommend that you book &pay in full as soon as possible to ensure the availability and pricing of anytravel services shown. Travel DocumentationPassports, Visas and Health: You areresponsible for ensuring that you possess all necessary documentation includingpassports and visas for your holiday. For all destinations, you should consultthe appropriate consulate. All travelers must have a valid passport forinternational travel. Many countries require passports to be valid for 6 monthsbeyond your stay. Visas & entry permits are required for many countries.Passports, visas & re-entry permits are the responsibility and cost of thecharterer. For health enquiries call your Travelers Medical / VaccinationCentre or see your Doctor. We recommend that you check travel advisoryinformation on your destinations. Cancellation orVariation of the yacht charter by the Yacht ChartererIf you, as the yacht charterer, wish to cancelyour yacht charter you must notify us immediately in writing. Cancellationwill be effective on the date at which I TRAVEL BY BOAT receives thecancellation. If you have notified us by email please follow up to check thatwe have received it. This agreement will govern the law and cancellationprocess.Cancellation/Amendment Fees: In the casethat a charter is cancelled, we as the agency reserved the right to retain anycommissions owing on the charter. If the reasons for your cancellationare covered under the terms of your insurance policy, you may be able toreclaim these charges. If you wish to make changes to the booking afterconfirmation, we will do all we can to make the necessary arrangements, but asan agent we may have to make additional charges. Cancellation andRefund PolicyIf you cancel the charter or part of thecharter the following refunds will apply: Time of cancellation Amount of the charter refunded More than 6 months before the first day of charter 100% (minus $150 of file fees) Between 90 to 179 days before first day of charter 40% Between 89 to 60 days before first day of charter 30% Between 59 to 30 days before first day of charter 20% Between 29 to 15 days before first day of charter 10% Less than 15 days to day of charter 5% Cancellation orVariation of the yacht charter by I TRAVEL BY BOATWe will do our best to provide the contractedfacilities but occasionally we may have to make a significant change to yourcharter yacht arrangements. The arrangements are made many months in advanceand it is sometimes inevitable that changes may become necessary. We reservethe right to, might this become necessary, change the chartered yacht toanother type of a similar or higher standard. We will advise you or your travelagent of this at the earliest possible date. We also reserve the right in anycircumstances to cancel your travel arrangements. We will contact you todiscuss alternative arrangements. If we are unable to provide an acceptablealternative, or if circumstances arise beyond our control, we may find itnecessary to cancel your holiday before departure. In this case we will returnin full all monies paid by you.Force Majeure: This means that we will not payyou compensation if we have to cancel or change your yacht charter or travelarrangements in any way because of war, riot, industrial dispute, terroristactivity, natural or nuclear disaster, fire adverse weather conditions or otherunforeseen circumstances that may amount to force majeure.We do not accept responsibility if the faultis caused by you or any member of your party, an unconnected third party or anevent which we or our supplier could not with due care have foreseen oravoided. We do not take responsibility for services provided by other land, airor sea carriers you will be using on your holiday. Our liability is limited inline with the appropriate international convention.We reserve the right in our absolutediscretion to terminate without further notice the yacht charter vacationarrangements of any client who refuses to comply with the instructions ororders of the company staff, agent or other responsible person whose behaviorin their opinions is likely to cause distress, damage, danger or annoyance toother customers, staff, any third party or to property. Upon such terminationour responsibility for your yacht charter ceases and we shall not be liable forany extra costs incurred by you. Any client who is denied boarding on theoutbound/inbound flight on the decision of the airline staff or aircraftcaptain shall be deemed to have given notice of cancellation on his/her bookingat that moment, and cancellation charges will apply in accordance withcancellation charges above. Laws of the countrywhere you or your charter yacht is locatedNo-one in your party should commit an actcontrary to the laws of the country. If any such act is committed, theagreement between us will automatically terminate, but without prejudice to ourrights and those of the owner of the charter yacht. You and/or your party willcarry full responsibility and answer to the appropriate Authorities. Travel InsuranceIt is obligatory that all members of yourparty have comprehensive travel insurance. By signing the chartercontract you confirm that all members of your party are covered by privatetravel insurance. In all scenarios, I TRAVEL BY BOAT is a sales intermediaryand cannot be held responsible for any event occurring on board or outside thevessel and during the transfers to/from the vessel. Yacht CharterComplaint ProcedureWe aim to provide youwith the best yacht charter possible, but if a problem occurs you must reportit to I TRAVEL BY BOAT as soon as possible, or to the captain who will try toresolve it on the spot. If you fail to follow this procedure I TRAVEL BY BOAT willhave been deprived of the opportunity to investigate and rectify your complaintwhilst you were on your yacht charter vacation and this may affect your rightsunder this agreement. The Charter Contract is made on the terms of theparticular yacht charter Booking Conditions and is governed in all respects by PanamanianLaw and shall submit to the jurisdiction of the Panamanian Court.
